1. Acceptance of Terms

By accessing or using www.themagmirror.com (the “Website”), you agree to comply with and be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not use the Website.

2. Changes to Terms

MagMirror may modify these Terms at any time. Updates will appear on this page; the date above will change. Continued use after changes constitutes acceptance.

3. Use of the Website

3.1 Eligibility

You must be at least 18 years old to use the Website.

3.2 Prohibited Activities

You agree not to:
• use the Website for any unlawful purpose;
• interfere with the Website, servers, or networks;
• impose an unreasonable load on our infrastructure;
• transmit viruses or harmful code;
• attempt unauthorized access to accounts or systems;
• employ automated scraping or data‑extraction tools without written permission.

6. Orders and Payments

6.1 Order Acceptance

All orders are subject to acceptance by MagMirror. We may refuse or cancel any order.

6.2 Payment

By providing payment information you confirm authorization to use it and authorize MagMirror or its processor to charge the full amount including taxes and shipping. Orders may be suspended or cancelled if payment is invalid.

7. Shipping and Delivery

Estimated delivery times are not guarantees. MagMirror is not liable for delays outside its control.

9. Limitation of Liability

To the fullest extent permitted by law, MagMirror is not liable for indirect, incidental, special, consequential, or punitive damages; loss of profits, data, or goodwill; or similar losses resulting from your use of or inability to use the Website.

You agree to defend, indemnify, and hold harmless MagMirror, its affiliates, officers, directors, employees, and agents from any claims arising out of your use of the Website or violation of these Terms.

11. Governing Law

These Terms are governed by the laws of Delaware, U.S.A., without regard to conflict‑of‑law principles. You consent to Delaware jurisdiction.

12. Dispute Resolution

12.1 Informal Resolution

Parties will attempt in good faith to resolve disputes within 30 days.

12.2 Arbitration

Any unresolved dispute shall be settled by arbitration in accordance with the Commercial Arbitration Rules.

13. Communications and Marketing

13.1 Email

By providing your email you consent to receive newsletters and promotional emails. Each email contains an unsubscribe link.

13.2 Opt-Out

You may opt out of marketing emails at any time via the unsubscribe link or by contacting us.

14. SMS Marketing Terms & Conditions

These terms govern participation in MagMirror’s SMS Messaging Service. By opting in you consent to receive recurring automated messages. Message frequency may vary. Message and data rates may apply.
You may text STOP to opt out or HELP for help. Carriers are not liable for delayed or undelivered messages. See full SMS Terms posted on the Website for details including cancellation, support, number transfer, privacy, and changes.

15. MagMirror “Creator Setup Struggle” Giveaway

15.1  Nature of Promotion

The Giveaway (“Contest”) is a free, skill‑based promotion. Chance plays no part in determining winners. Void where prohibited or restricted by law.

15.2 Eligible Countries

Legal residents, 18+ years, of: United States; Canada (excluding Québec); United Kingdom; France; Germany; Spain; Netherlands; Belgium; Poland; India; South Korea; Hong Kong SAR; Malaysia; Australia; New Zealand; South Africa; and Nepal.

15.3  How to Enter

Basic Entry – Submit the online form and follow @MagMirror on at least one supported platform to receive one (1) entry and a 5 % discount code (single‑use, non‑transferable, 12‑month validity).

Bonus Entry – Post one (1) original ≤30‑second vertical video that:
• shows a content‑creation problem and how MagMirror solves it;
• includes hashtags #MagMirrorMagic and #ad;
• tags @MagMirror.
Limit one bonus video per person. Bonus entrants receive five (5) additional entries and a 10 % discount code.

15.4  Judging & Prizes

Valid bonus videos are scored: Creativity 40 %, Relevance 30 %, Clarity 30 %. The five (5) highest‑scoring entrants (max two per country) each receive one (1) MagMirror device (ARV US $169). Winners pay any taxes or import duties.

15.5  Discount Codes

Codes have no cash value, cannot be combined, and expire twelve (12) months from issuance.

15.6  Licence & Publicity

By submitting content you grant MagMirror a worldwide, royalty‑free licence to repost your video organically in perpetuity and promote it via paid ads for up to ninety (90) days. You consent to use of your first name, likeness, and voice.

15.7  Disqualification

Entries containing unlawful or infringing content, or posts deleted or set to private within thirty (30) days, may be disqualified and associated discount codes revoked.

15.8  Sponsor

16. Miscellaneous

16.1 Entire Agreement

These Terms constitute the entire agreement between you and MagMirror regarding use of the Website.

16.2 Severability

 If any provision is unenforceable, the remainder remains in effect.

16.3 Waiver

 Failure to enforce any right is not a waiver of that right.
